The Supreme Court delivered a safe verdict in the case of Justice Qazi Faiz Issa. The matter of formation of the bench for hearing the case has been handed over to the Chief Justice of Pakistan.
According to private TV ARY News, the Supreme Court delivered the reserved judgment on December 10.
Justice Umar Atabandial, the head of the bench, delivered the reserved judgment. The judgment was delivered by five to one. Justice Manzoor, a member of the six-member larger bench.
Disagreeing with the decision, Justice Manzoor Ahmad Malik will write a dissenting note.
The Supreme Court said that the power to form a bench rests with the Chief Justice of Pakistan.
If the Chief Justice so wishes, he can form a larger bench on petitions. The court said that the judges who write the verdict must be in the service if they are in the service. The decision-making bench hears the review petitions.
The review bench must include a judge to write the decision.
The court said that if the judge who writes the decision is not available, the judge agrees with the order. The matter was referred to the Chief Justice of the Supreme Court for formation of a bench.
